  Q. Let us take fat. We will take your figure. You say the
US Government's recommended daily proportion or proportion
of energy consumed as fat as 30 per cent; is that right?
       A. I believe it is a recommended daily value, or words to
that effect; 30 per cent calories from fat. Yes, sir.

  Q. Of which saturated fat should not form more than about a
       third?
       A. I believe you are correct.

  Q. If one wants to avoid endangering one's health one tries
to confine one's intake of fat to around those sorts of
       levels, does one not?
       A. One in general, or this one?

  Q. You, for example, but the world at large, if you like?
       A. The recommended figure is 30 per cent. That is in the
United States something of an attainment goal. Americans,
as a whole, eat on average more than 30 per cent calories
       from fat.

  Q. If you are anxious to remain healthy, yes, one of the
matters to which you will attend is your diet, is it not?
       A. In my case, yes.

  Q. No, I mean a person should attend to his or her diet if he
or she wishes to remain healthy?
       A. Yes.

  Q. Not to risk the occurrence of degenerative diseases, for
       example?
       A. Diet is, has been shown to be directly linked to one's
health, including the occurrence of degenerative diseases,
       so yes.

  Q. In the same way as one must be careful how much alcohol
       one consumes; correct?

  Q. It is, is it not, Mr. Gardner, a question of moderation
       and balance, is it not?
       A. It is what, Mr. Rampton?

  Q. A healthy diet.
       A. Yes.

  Q. I am interested to know, Mr. Gardner, what it is that you
mean when you say that McDonald's food as a whole is not
       nutritious. Can you please explain?
       A. As I have testified, nutritiousness, or nutrition, to
the average American consumer conveys a sense of a healthy
product that is not deleterious to one's physical
wellbeing. Specifically, a product that is nutritious is
one that does not contain excessive amounts of nutrients
that should be avoided, such as fats, sodium and the like.

  Q. When you say "avoided" do you mean avoided in all
       circumstances and for all time?
       A. No, sir.
