1 kids, who were quite a large part of the campaign, up to
retired people?
2 A. That is correct. It was composed of a wide cross
section of American society in so far as the composition
3 of these different actions, the composition of the people
involved in these actions are concerned.

Q. I think there was a second day of action on Earth Day,
5 which is in April, in 1988?
A. That is correct.

Q. Then there was a third day of action in April 1989. By
7 that time what was going on?
A. Well, as time went on and more people became aware of
8 the McToxics campaign and the concerns associated with the
use of foam food packaging, larger numbers of groups
9 became involved in demonstrations, and we found that high
school students, elementary school students, teachers and
10 the parents of these students, even government and
business officials, were joining in the campaign or
11 contributing in some fashion to the campaign to get
McDonald's to stop using foam, acknowledging the
12 environmental issues associated with the foam food package
or otherwise, in some cases, for example, with
13 municipalities seeking to eliminate or bar the use of
disposable foam in other plastic packages from food
14 service restaurants within their jurisdiction.
15 Q. I think also -- you may have mentioned corporations, but
health care workers and politicians were also involved in
16 the campaign?
A. It became apparent that the issue had a lot of appeal,
17 that a lot of people were capable of recognising and
understood in some way the technical and health related
18 issues associated with the foam food package. It came to
be -- it was recognised as an issue that many people were
19 prepared to be involved in because they understood the
nature of the problems.

Q. They were concerned about it?
21 A. That is right.
22 Q. To go back, you mentioned municipalities, I think, Suffolk
County, New York?
23 A. I can specifically name four communities that I know
passed orders to bar the use of foam. Freeport, Maine,
24 the community of Freeport, Maine, barred the use of foam
food packaging; the community of Berkeley, California; the
25 community of Portland, Oregon; and the community of
Suffolk County, New York. I am also aware McDonald's
26 filed suit to or -- I have to correct that. A group,
I believe a group of organisations associated with food
27 packaging manufacture filed suit against Suffolk County,
New York, to stop them from implementing the foam ban.

In addition, I would also add with reference to research,
29 the vice president of McDonald's Shelby Yastrow in 1989,
during a meeting with members of my organisation, passed
30 on a copy of a list of local municipalities across the
country that were engaged in or implementing or
